The emails currently roiling the US presidential campaign are part of some unknown digital collection amassed by the troublesome Anthony Weiner, but if your purpose is to understand the clique of people who dominate Washington today, the emails that really matter are the ones being slowly released by WikiLeaks from the hacked account of Hillary Clinton’s campaign chair John Podesta. They are last week’s scandal in a year running over with scandals, but in truth their significance goes far beyond mere scandal: they are a window into the soul of the Democratic party and into the dreams and thoughts of the class to whom the party answers

The class to which I refer is not rising in angry protest; they are by and large pretty satisfied, pretty contented. Nobody takes road trips to exotic West Virginia to see what the members of this class looks like or how they live; on the contrary, they are the ones for whom such stories are written. This bunch doesn’t have to make do with a comb-over TV mountebank for a leader; for this class, the choices are always pretty good, and this year they happen to be excellent.

They are the comfortable and well-educated mainstay of our modern Democratic party. They are also the grandees of our national media; the architects of our software; the designers of our streets; the high officials of our banking system; the authors of just about every plan to fix social security or fine-tune the Middle East with precision droning. They are, they think, not a class at all but rather the enlightened ones, the people who must be answered to but who need never explain themselves.

A reader points out the irony of Hillary Clinton complaining about timing of the reopening of the FBI investigation. In 1992, the reader reminds me, President Bush was gaining on Bill Clinton as Election Day approached. But just four days before the election, the special counsel, Lawrence Walsh, obtained a new indictment of former Secretary of Defense Caspar Weinberger.

Weinberger had been indicted earlier in the year. But the new indictment cited a Weinberger diary entry that contradicted something President Bush had said.
 
The Clintons seized on the new indictment, howling about a “culture of corruption” that supposedly pervaded the administration. Bush’s poll numbers declined and Bill Clinton won the election.

Shortly after the election, a federal judge threw out the new indictment because it violated the five-year statute of limitations and improperly broadened the original charges. President Bush then pardoned Weinberger.

Keep this history in mind during the coming days when you hear Democratic hacks talking about how awful it is for law enforcement officials and/or prosecutors to “interfere” in the presidential election process.

Today’s bombshell news, of course, is that the FBI has found a substantial number of emails from Hillary Clinton to Huma Abedin on the computer (desktop, I assume) that Huma shared with her husband, Anthony Weiner. The FBI was examining the computer’s hard drive to investigate whether Weiner had conducted a crime by sexting with an underage girl. Imagine the astonishment of a tech guy at the FBI who found, not only Weiner’s illicit texts, but a trove of emails from Hillary Clinton.

I don’t believe the email address that Abedin used on her home computer has been revealed, although Drudge says it is humaabedin@yahoo.com. I was curious to know whether Abedin had disclosed this email account in her deposition in the Judicial Watch case that I wrote about here, so I looked it up.

In a bid to put the issue of illegal immigration back into the presidential debate, outspoken critic Sen. Jeff Sessions on Monday issued a "Critical Alert" warning of a potentially historic surge of over the border.

"We are simply overwhelmed," his statement said. In it he estimated the Fiscal Year 2016 illegal crossings at 817,740.

"There is a crisis at our southwest border — one that in many ways exceeds the crisis we saw just two years ago, one that further undermines the integrity of our immigration system, but one that the most of the media has elected to ignore," said Sessions, an advisor to Republican presidential nominee Donald Trump.

“Who drove the South to these extremities? The very men who accuse her of treason. When she accepted the contest, to which she was thus virtually invited in terms of contumelious threat and reproach, she was threatened with being wiped out and annihilated by the superior forces of her antagonist, with whom it was vain and foolish to contend, so unequal were the strength and resources of the two parties. It is true that the South parted in bitterness, but it was in sadness of spirit also. She did not wish it – certainly, Virginia did not desire it – if she could maintain her rights within the Union.

The South at last fell from physical exhaustion – the want of food, clothes, and the munitions of war; she yielded to no superiority of valor or of skill, but to the mere avoirdupois of numbers. Felony mishandling of classified information, including our nation’s most closely guarded intelligence secrets; the misappropriation and destruction of tens of thousands of government records — these are serious criminal offenses. To this point, the Justice Department and FBI have found creative ways not to charge Hillary Clinton for them. Whether this will remain the case has yet to be seen. As we go to press, the stunning news has broken that the FBI’s investigation is being reopened. 
 
It appears, based on early reports, that in the course of examining communications devices in a separate “sexting” investigation of disgraced former congressman Anthony Weiner, the bureau stumbled on relevant e-mails — no doubt connected to Huma Abedin, Mr. Weiner’s wife and, more significantly, Mrs. Clinton’s closest confidant. According to the New York Times, the FBI has seized at least one electronic device belonging to Ms. Abedin as well. New e-mails, never before reviewed by the FBI, have been recovered.

Huma Abedin may have denied that any other phone existed, and if she did, she committed a felony. She lied to the FBI just like General Cartwright, and if she did, she’s dead meat, and Comey knows it, and there’s nothing he can do about it.
This last Friday it became public record that FBI Director James Comey reopened the Hillary Clinton email server investigation after repeatedly testifying before Congress and the world up to last July that he’d closed the case, after in his words not finding sufficient evidence of “any criminal wrongdoing” to indict her in spite of her four years as Secretary of State egregiously breaching our national security:’ 
 
-committing obstruction of justice and willful tampering with evidence, 

-deleting 30,000 emails after receiving a court subpoena constituting destruction of evidence, 

-not to mention repeatedly engaging in perjury before Congress and the FBI.

But obviously a federal investigation still in process in late June never stopped Bill Clinton’s illegal ambush at the Phoenix airport of Comey’s boss US Attorney General Loretta Lynch (image right) “clearing” the way for Hillary to proceed without consequence to be anointed as the next US figurehead puppet president by the ruling elite. 

Because it’s so blatantly obvious to the entire world that Hillary is guilty as sin, Comey’s whitewash didn’t go over well with either Americans or longtime FBI agents who reacted angrily to Comey’s over-the-top corruption.

Pristine, 71K, tint, dealer maintenance records from the one owner who always garaged it as you can see from the sheen.

Fridays FBI letter to Congress revealing that a new trove of "pertinent" emails had been found on a laptop computer accessable to both Clinton aid Huma Abedin and her disgraced, sleaze ball, ex-Congressman and soon to be ex-husband Anthony Weiner, has raised speculations and accusations of every sort imaginable.


For the moment let's put the furious accusations about the motives of Director Comey aside. As such they amount to little more than closing the barn door after the horses have escaped. The speculations about what the emails actually contain is almost irrelevant to the unfolding drama.

History will undoubtedly say that the Comey announcement that the FBI is reopening its investigation into Hillary’s emails that turned the 2016 race around and brought Hillary down. But that’s a false narrative. And to grasp what is happening, we must put it aside and concentrate on the real reasons Trump began to overtook Hillary in the week leading up to Comey’s announcement on Friday, October 28th.


Polling suggests that Trump’s gains predate Comey’s announcement. Most dramatic was the heavily Democratic biased ABC poll that began the week giving Hillary a 12 point lead and ended the week with Mrs. Clinton clinging to a one point margin. Most ABC interviews were conducted well before Comey spoke.

So what happened?

• Trump’s negative ads began to hit in swing states. Until this week, Hillary’s attacks on Donald had been dominating the airwaves for months. But, during the past ten days or so, his negative ads — devastatingly effective — began to make their impact felt.

• ObamaCare premiums increases began to hit. While the full impact of the price hikes won’t be felt until after November 1st — in time for the election — the early notices that they would go up by an average of 25% with many even higher, had a big impact on the race. And Trump moved adroitly to exploit the increases in his speeches.

• Before the Comey bombshell, the drip-drip-drip of WikiLeaks emails had been taking a daily toll on Hillary’s vote share. The coup de grace was the memo from Doug Band (Read it!) that was written in response to Chelsea’s accusation that she had not done enough for her father. Stung by the first daughter’s charges, Band ticks off the deals that led to a $60 million personal profit for Bill Clinton, a list that vindicates the direst of the pay-for-play accusations.

• Hillary’s illness prevented her from campaigning more vigorously and her campaign staff, obtuse as ever, failed to give her new issues and material to use on hitting Donald. Once they ran out of abused women to complain about Trump, they had nothing to say.

The FBI obtained a warrant to search emails related to the probe of Hillary Clinton's private server that were discovered on ex-congressman Anthony Weiner's laptop, law enforcement officials confirmed Sunday.

The warrant came two days after FBI Director James Comey revealed the existence of the emails, which law enforcement sources said were linked to Weiner's estranged wife, top Clinton aide Huma Abedin. The sources said Abedin used the same laptop to send thousands of emails to Clinton.

The FBI already had a warrant to search Weiner's laptop, but that only applied to evidence of his allegedly illicit communications with an underage girl.

Agents will now compare the latest batch of messages with those that have already been investigated to determine whether any classified information was sent from Clinton's server.

A poll released Sunday shows more than 30 percent of likely voters say they are less inclined to support Democratic presidential nominee Hillary Clinton after revelations Friday about the FBI reviewing newly-discovered emails potentially related to Clinton's tenure as secretary of state.

The ABC/Washington Post tracking poll was conducted from Tuesday to Friday, which means the survey’s 1,781 respondents could only be asked on the final day about the revelations regarding the new emails.

Hillary Clinton campaign manager Robby Mook admitted on Fox News Sunday that Clinton lied when she claimed FBI Director James Comey’s letter about the reopening of its probe into her private server was sent solely to House Republicans.

Comey’s stunning letter Friday stated that “pertinent” emails regarding the private server investigation surfaced during a separate inquiry. Later reporting revealed that separate investigation was into former congressman Anthony Weiner’s sexting with a 15-year-old girl. Weiner is the estranged husband of top Clinton aide Huma Abedin.

Comey sent his letter to Republican House committee chairmen but it was also carbon-copied to leading Democrats on those committees. However, Clinton said it was sent originally just to Republicans, suggesting Comey’s actions were partisan.

The Justice Department and the FBI are in discussions with lawyers for Huma Abedin to conduct a full search of new emails discovered on her husband's computer that turned up during another investigation, CNN reported Sunday.

Investigators believe it's likely the newly recovered trove will include emails that were deleted from Democratic presidential candidate Hillary Clinton's server before the FBI took possession of it as part of an earlier investigation that many thought had concluded in July, CNN reported.

Nothing has provoked the ire of America’s bipartisan political class as much as Donald Trump’s recent proposal that the U.S. should suspend the acceptance of refugees from Syria and other terrorist-supporting nations until we find a way of perfecting the screening process to ensure that we are not admitting terrorists or terror sympathizers. On its face this proposal was not unreasonable.

Most of these refugees do not have adequate documentation, intelligence agencies do not have sufficient information to determine whether or not they have terrorist connections or intend to engage in terrorism, and the heads of our security agencies have warned that active terrorists will inevitably slip through security screening cracks. Nor is it as if there was no reasonable alternative. Wouldn’t it have been better, as Trump and others have suggested, to address the refugee crisis by setting up security zones in Syria or other Middle Eastern countries where refugees could find safety and where Muslim nations might feel obligated to help finance their care? In addition to making sense from a national security perspective, this would also have been a more humane solution, since it would not have uprooted the refugees from their homelands and injected them into an alien way of life.

Why are our political leaders, despite these facts, willing to expose the nation to such potential danger?—a danger that is surely greater than we now imagine.

Burns Chronicles No 37 Intent v. Effect

There has been no substantial interview regarding the deliberations that resulted in 12 Not Guilty Verdicts, and One Verdict where the jury could not get consensus.  However, we do have a bit of information that is probably the most critical single piece with regard to understanding just what happened that led to those verdicts.

Juror #4, the juror that brought Judge Brown the indication of bias by Juror #11, has stated that the government failed to show that the occupiers had the intention to impede the government employees.

That the failure of the employees to report to the Refuge may have been an effect of the occupation.

Since the Jury Instructions required the government to prove “intent”, the jury had to find them Not Guilty, at least with regard to Counts One and Two.  In a written statement, Juror #4 said, “All 12 agreed that impeding existed, even if as an effect of the occupation.”  The difference between “effect” and “intent”, then, becomes the foundation for this article.

However, first, a bit of an explanation.  I seldom bring politics into any of my articles, however, to put this situation in a proper context, I think it is necessary to do so, now.  Whether what I am going to bring to your attention had anything to do with their verdict, or not, is yet to be known.  If it was not considered, then the irony of the comparison still should be of interest to all.

Addressing those matters that were brought to our attention, this past Friday, regarding Hillary Clinton’s email server and the possibility that criminal pedophiliac material may have gone through that server.  That material could possibly be emails from former Representative Anthony Weiner (New York (D)), through his wife, Muslimah Huma Abedin*, through Hillary’s rather suspicious email server, to an underage girl.

* Huma AbedinFormer deputy chief of staff to U.S. Secretary of State Hillary Clinton, and still a prominent figure in Hillary’s campaign for President.

UPDATE from Gary

There were seven defendants in the just concluded trial in Portland.  They are Ammon Bundy, Ryan Bundy, Shawna Cox, David Lee Fry, Jeff Wayne Banta, Kenneth Medenbach, and Neil Wampler.

Of those, only two, Ammon and Ryan Bundy, were also charged in Nevada.  They have been detained by the US Marshals for transfer to Nevada.

Marcus Mumford raised the question of them being detained after the not guilty verdict.  That led to him being thrown down on the courtroom floor, tazed, and charged with resisting arrest and disorderly conduct.  He has a hearing date set to answer to those charges, though he was released within a couple of hours.

We have found no outstanding arrest warrant, or any other paperwork that allow them being detained, though we have not gone through the many hundreds of documents on file in both the Oregon and Nevada cases.

In the meantime, they will probably be transferred to Nevada within a few days.  The government likes to keep secret those transfer dates, since there are so many bad characters out here that might raid the transport and free them -- so that they can walk into court and defend against the charges without having to wear handcuffs or prison clothes.

A former FBI official said Sunday that Bill and Hillary Clinton are part of a “crime family” and argued top officials hindered the investigation into Hillary Clinton’s private email server while she was secretary of State.

During a radio interview with John Catsimatidis, former assistant FBI director James Kallstrom heaped praise on Republican presidential nominee Donald Trump before taking aim at the Clintons.

“The Clintons, that’s a crime family, basically,” Kallstrom said. “It’s like organized crime. I mean the Clinton Foundation is a cesspool.”

Kallstrom, best known for leading the investigation into the explosion of TWA flight 800 in the late '90s, said that Hillary Clinton, the Democratic presidential nominee, was a “pathological liar.”

He also blasted Attorney General Loretta Lynch, claiming that she impeded the investigation into Clinton’s private server.

Update on the latest Clinton FBI investigation—

According to The New York Times, as of Saturday night, the FBI had still not gotten approval from the Obama Justice Department for a warrant that would allow agents to read any of the newly discovered Abedin emails.

The Obama DOJ was hampering an FBI investigation.

Claude Kitchin represented North Carolina in the U.S. House during the early 20th century and served as Speaker of the House during the First World War. Though he was a Democrat, he is remembered for risking his political career to oppose President Woodrow Wilson on questions of U.S. foreign policy: Kitchin consistently opposed Wilson’s attempts to expand America’s role in world affairs. On other issues, Kitchin adopted parts of the Populist and Progressive agenda and often aligned his positons with those of William Jennings Bryan.

Kitchin was born near Scotland Neck in Halifax County, North Carolina on March 24, 1869.  He was one of 11 children born to William Hodges Kitchin and Maria F. Arrington.  William Kitchin, a Confederate veteran, struggled as a prominent but debt-ridden planter who supported the Farmers’ Alliance and served one term in the U. S. Congress shortly after Reconstruction.  Claude’s older brother William also served in the House (1897-1908) and later as governor (1909-1913).

Anyone who has grown up in the melting pot of immigrant religiosity of the industrial northeast has a very specific vision of Southern religiosity – evangelical, provincial, low-church, and rabidly anti-Catholic, among other things. Even growing up in a household sympathetic to the South, I had plenty of condescending ignorance about the way Southrons practiced their religion. Grab a Bible, flip on Billy Graham, and say “Amen”, and you’re more than half-way there.

Nuance to any ignorant view comes only with closer acquaintance – and that closer acquaintance for me took the form of spending more than three quarters of my adult life south of the Mason-Dixon, from Washington, DC to Memphis, TN, thence to Maryland and now in Georgia. I found the rich history of traditional Christianity throughout the South and met a large number of High Church Southern men and women, Anglicans and Catholics and – especially surprising to me – Orthodox Christians. It is this last group that played the greatest role in my religious life: I was received into the Orthodox Church by a Georgian; in Pennsylvania I heard liturgy at a parish Bishop George, abbot of the Hermitage of the Holy Cross in West Virginia, and the pastor of my parish now is an Appalachian convert.

Only a year after the fall of the Confederacy, Secretary of State Judah P. Benjamin had become a British barrister – by 1868 he had risen to Queen’s Counsel. An advocate of using former slaves in Southern armies, Benjamin saw that after the Confederate Congress approved of this in March 1865, no longer could the North claim it was fighting a war to free the slaves. Benjamin was severely injured in a streetcar crash in May 1880; against his physician’s advice, he returned to his law practice but was forced to retire in 1883.  He died ten months later in Paris.

Judah P. Benjamin, Legal Giant of His Age

“Judah Philip Benjamin, Louisiana’s most illustrious lawyer, was born a British subject of Jewish descent on the island of St. Thomas, West Indies, on August 6, 1811. As a child he moved with his parents to Charleston, South Carolina, and was educated at Fayette Academy, [Fayetteville] North Carolina, with two years at Yale. He left Yale at seventeen to accept a position with a commercial house in New Orleans. Poor but resolute, he supplemented his wages as a tutor in English.

Later employed as a clerk in a notary’s office Benjamin prepared for the law and passed the State bar examinations in 1832, just as he came of age. He gained something of a local reputation because of a published digest of decisions of the [United States] Supreme Court and rose rapidly at the bar. His part in the celebrated Creole case, involving delicate questions of international law, gave him national standing.

In his prosperity he purchased a plantation and made a study of sugar chemistry and new refining processes.

He was elected to the State legislature as a Whig in 1842, and ten years later to the United States Senate, serving two consecutive terms. He was the leading spirit in drafting the State constitution in 1852.

Active in the commercial development of New Orleans, Benjamin was one of the organizers of the Jackson Railway, now the Illinois Central. He projected a railway across the Isthmus of Tehuantepec, Mexico, and was of the opinion that the Compromise of 1850 placed the South at a national disadvantage that only an outlet to the trade of the Pacific could overcome.

When Lincoln was elected president, Benjamin advocated secession, and shortly after the withdrawal of Louisiana, he made a brilliant speech of resignation to the Senate.

Three weeks later [President] Jefferson Davis called him to the Confederacy’s cabinet as attorney general. Phlegmatic in temperament, Benjamin’s personality was a complement to the President’s high-strung spirit. Davis made him secretary of war in 1861, just when the problem of obtaining munitions from Europe had become acute . . . [and later] Davis appointed him secretary of state.

In 1864-65, Benjamin believed the cause of the Confederacy so acute that only the enrollment of slaves as volunteers, with the promise of freedom, could stem the tide. [After Congress had approved the use of black troops] an agent was sent to London, promising general emancipation in return for British aid in lifting the federal blockade. He was told that he had come too late.

When Richmond fell, Benjamin fled with the President’s party [but before Davis’ capture], Benjamin, unable travel farther on a horse, left his chief and escaped from the coast of Florida in an open boat. After many vicissitudes he made his way to the West Indies and to England.

At fifty-five he started life all over as a student of English law at Lincoln’s Inn in London. With a little money he eked out a livelihood as a writer for the Daily Telegraph. In recognition of his talents, the Benchers of his Inn of Court waived the usual three-years’ rule, calling him to the bar after less than five months.

Liverpool was the market for Southern cotton, and its business leaders had many connections with the merchants and shippers of New Orleans. Benjamin located in that circuit just as the last of his little fortune was swept away by the failure of his bank in New Orleans.

He had been engaged in the preparation of a Treatise on the Law of Sale of Personal Property which he published in 1868. Retainers immediately poured in upon him. He was made Queen’s Counsel, qualified to practice in all courts of common law and equity, and established himself without superior in cases on appeal.

His annual fees reached seventy-five thousand dollars, and his practiced increased until he was forced to confine his talents to cases before the House of Lords and Privy Council. Between 1872 and 1882, he appeared as counsel in no less than 136 important cases which came from every part of the British Empire.

Lawyer and statesman, known as the “Brains of the Confederacy,” Judah P. Benjamin was one of the legal giants of his age. His source of power lay in his profound knowledge of the law, his keen sense for analysis, and his faculty for succinct statement. Dynamic in determination, he rose again and again from defeat and poverty to success and fortune.”
