NC Declared 'Gun Free Zone' In Anticipation Of Hurricane Earl

Read about this unconstitutional "law" which should be ignored (I immediately did) since our natural rights trump this Marxist edict.

  1. So, you now have a choice to either; 1) be criminal and keep your family and property safe, or 2) take a chance of possibly dying at the hand of a gun toting criminal (possibly with a badge) along with the rest of your law abiding family.

  3. As soon as I saw the edict, I went to Loew's and the gas station with my normal LCR on me and my Glock 30 in the car, but the article below made me realize that this edict made a criminal of me and now I'm more pissed than I was initially.

    State of emergency order makes criminals of concealed handgunpermit-holders, sport shooters and hunters... "Even if EO 62 were worded...to expressly permit the possession offirearms, the governor has no constitutional or statutory authority tosuspend the effect or enforcement of a valid NC criminal law."

    The State of Emergency order issued by Governor Beverly Perdue inresponse to Hurricane Earl makes carrying a firearm outside one's homeor place of business a Class I misdemeanor. Beyond law enforcement andthe military there are no exceptions: Not for hunters, sport shootersor concealed handgun permit-holders. Worse, with the legislature out of session, there is no immediate wayto address the crisis.

    As NC gun owners are aware, GRNC is amongplaintiffs on a lawsuit against the State of Emergency law, arguingthat it violates the Second Amendment, but legal redress is months, ifnot years away.

    PERDUE'S LIE Gov. Perdue's office has been issuing various denials to input aboutthe gun ban implications of the SoE, but the most blatant misstatementis this: "Thank you for contacting the Office of the Governor. After checkingwith legal counsel, we are pleased to inform you that THE CURRENTSTATE OF EMERGENCY WAS WRITTEN IN SUCH A WAY THAT THE RIGHTS OF NC GUNOWNERS ARE NOT INFRINGED UPON. . However, localauthorities still have the authority to establish states of emergencywithin their jurisdictions that may impact your right to carryweapons."

    THE TRUTH From GRNC legal counsel Ed Green: "On Sept. 1, 2010, Governor Perdue issued Executive Order No. 62declaring "that a state of emergency exists in the State due to theapproach of Hurricane Earl." Nothing in EO 62 mentions gun owners orthe possession of guns in any way. Nothing in EO 62 purports tosuspend the operation of any NC law. "NCGS § 14-288.7 clearly and unambiguously forbids the possession ofany firearm off one's premises during any declared State of Emergency,with exceptions only for law enforcement and military in the course oftheir duties. Under NC law, whenever a State of Emergency is declared,no citizen may possess any gun outside of their home. "Even if EO 62 were worded (or amended) to expressly permit thepossession of firearms, the governor has no constitutional orstatutory authority to suspend the effect or enforcement of a valid NCcriminal law. Once she declared a State of Emergency, Gov. Perduelegally disarmed all NC civilians outside their own homes, includingthe thousands of otherwise legally licensed hunters expected to taketo the fields for the opening of Dove season at noon Saturday."

    HUGH HOLLIMAN'S GUN BAN Most responsible for the debacle is NC House Majority Leader HUGHHOLLIMAN (D-Davidson, GRNC 0-star), who in his leadership role deniedcommittee hearings to not just one, but TWO pieces of GRNC-supportedlegislation that would have prevented it. Interestingly, Holliman faces a tight race against Republicanchallenger RAYNE BROWN, who returned GRNC's "Remember in November"candidate survey with a perfect score, earning GRNC's highest 4-star(****) evaluation.

    Hurricane Earl moves through the Atlantic Ocean toward the U.S. coast, leading three Governors to declare states of emergency.

    State of emergency order makes criminals of concealed handgun permit-holders, sport shooters and hunters.

    [Raleigh] Yesterday, North Carolina Governor Beverly Perdue signed Executive Order No. 62, declaring a State of Emergency in advance of Hurricane Earle. In doing so, Perdue suspended the right of state residents to use or carry firearms outside their premises.

    At issue is N.C. General Statute 14-288.7, which prohibits transporting a “dangerous weapon” during a state of emergency:


    NC DEMOCRATS REFUSE TO RECTIFY PROBLEM

    In recent years, two North Carolina bills could have prevented infringement on individual rights under state of emergency laws. Under Section 3 of House Bill 257: “No Seizure of Lawful Firearms in Emergency,” sponsored by Rep. George Cleveland (R-Onslow) and three other legislators, lawfully possessed firearms and ammunition would have been exempted from the state of emergency law.

    LAWSUIT PENDING ON STATE OF EMERGENCY LAW

    Ironically, in June GRNC joined Michael Bateman, Virgil Green, Forrest Minges, Jr., and the Second Amendment Foundation in a lawsuit against the state’s emergency powers gun ban.

    Named in the suit are North Carolina Gov. Beverly Perdue; Reuben Young, secretary of the Department of Crime Control and Public Safety; Stokes County and the City of King.

    Filed in U.S. District Court for the Eastern District of North Carolina, the official title is Bateman et al v. Perdue et al, Case No. 5:10-cv-265. It contends that state statutes forbidding carrying of firearms and ammunition during declared states of emergency, as well as laws enabling government officials to prohibit purchase, sale and possession of firearms and ammunition are unconstitutional because they forbid the exercise of Second Amendment rights as affirmed by the Supreme Court ruling in McDonald v. Chicago.

    Plaintiffs are represented by attorney Alan Gura, who won the recent McDonald v. Chicago Second Amendment case and the landmark D.C. v. Heller case preceding it. Local counsel includes Andrew Tripp and Kearns Davis of Brooks, Pierce, McLendon, Humphrey & Leonard, LLC.

    This makes no sense at all, in times of riots and such is when I will be carrying a gun with me everywhere. Period. Beverly Purdue and her Cohorts may talk all they want and sign all the bills and laws they want but I will continue to carry my gun for self protection mainly from them. I may be old but my aim is still good.

    I knew when the Great Oshamema sanctimoniously concerned about the citizens of NC and designated it in a emergency state? Get real these people on the outer banks have withstood more storms and lashing from the ocean than obama could even count and he is going to protect them from nature??? Too bad he won't protect them from his friends.

    What are these folks supposed to do with their guns and ammo now? Leave it in their homes for the looters? I can guarantee not one of these local men will be leaving everything they have worked for and high tail it to a comfy motel inland until they know for sure it is going to be too rough to ride it out.

    Homeland security will certainly protect us all from the bad guys Right? Like hell they are the bad guys and I put no faith in anything they say or do. Will they have check points to see if anyone leaving the islands are carrying a weapon? Will they be able to get that weapon back after the emergency is over? That is a big laugh. Those people in La. still haven't gotten their guns back.

    Obama and Purdue are right this is a "state of emergency" and it has nothing to do with the weather.

    God Save us all. But just in case keep your guns loaded, God always likes a little help.
